This paper summarises survey findings in New Zealand, Australia, Europe and Germany on the extent of ‘hate crimes’ and exposure to ‘hate speech’. A difficulty is that these surveys use broad and subjective definitions of ‘hate speech’ that, if carried over into legislation, would undermine the right to freedom of expression. The paper offers a definition of 'hate crime' and 'hate speech' informed by international human rights law, scholarly debate and existing regulation in the United Kingdom, Denmark, Canada, Germany and New Zealand.
