It is possible that next week the government will get acquainted with the case of Tatjana Slivenko that the European Court of Human Rights (ECHR) has accepted for reviewing. As LETA was told by Latvia's representative at international human rights institutions Kristine Malinovska, ECHR may send additional information on the court proceedings, and after that the government will be able to decide on further action. ECHR last week rejected a petition filed by Nikolai Slivenko, the husband of Tatyana Slivenko, on refusing him a residency permit, since the convention does not refer to Russian military officers. Their exiting Latvia was set by the Latvian-Russian treaty signed in 1994.

When informing about the visit of the President Vaira Vike-Freiberga to the USA newspaper Chas states that MPs have spoiled this visit by not supporting her proposal.

MPs S.Dreimane and I.Udre from the New Faction state that the Satversme of the Republic of Latvia stipulates that to the Saeima may be elected any citizen, who is more than 21 years of age but at the same time in the Satversme is said that the state language in Latvia is the Latvian language. Therefore the New Faction is positive about the PresidentТs proposal to abolish the language proficiency norm for deputy candidates but considers Ц while there are not developed effective control mechanism of state language usage and the government has not found financing for this in the sate budget, it is not possible to implement PresidentТs initiative. This is an extremely essential question for society and needs calm evaluation of the situation and weighted out actions to observe the Satversme and not to weaken the positions of the Latvian language as the state language. It is evident that the position of the ruling factions against this proposal is nothing more than a pre-election posture.

Social Anthropologist A.Putnina analyses the Latvian language situation in the context of PresidentТs proposal to amend the election laws. The discussion on this proposal shows a serious problem I the Latvian society. First of all it witnesses a split society, secondly, about a possibly unstable political situation. These are conclusions when examining the argumentation of the PresidentТs opponents. A.Putnina is worried about the possible outcome of the situation. The first way out could be that in the result of EU oriented forces we might pretend that we are not afraid, that the situation is stable and adopt the amendments. Other option could be Ц not to bother about EU and concentrate on the next election. The third way out could be to wade in to the core of the problem and investigate the reasons for this fear and find the means of prevention.

V.Krustins writes about the letter of US Deputy State Secretary R.Armitage to Latvian Minister of Foreign Affairs I.Berzins. Krustins states that it is clear how to call this letter. The idea of it is clear, УPay to President Vaira Vike-Freiberga for her brave political bill, i.e. abolish the language proficiency norm. And this bill will be paid for because the only party opposing amending the election laws was FF/LNNK. And it remains for the Saeima to agree with the President Ц although she is brave, but brave while coordinating her activities with the legislators, who elect her. Krustins foresees that there will be unsatisfied people, who will say that it was pliancy to pressure. And Mr.Krustins suggests saving energy for bigger trouble. Of course, it is bad that as deputies could be elected persons, who do not know the state language or has no intention to know it. May it would be better for electors to pay more attention to the behavior of political parties, even concerning this issue. Because it is a problem of Уbig policyФ that we can influence. In reality it means to choose that power we want in Latvia.

Mr.Carlson writes that he noticed the unofficial questionnaire of FF/LNNK, published in this newspaper asking for readersТ opinion whether deputy candidates had to know the state language. The Ambassador does not doubt the answer Ц they have to. Nobody argues that the Latvian language has to be the official working language in the government of Latvia. In essence the leaders of FF/LNNK already decide among themselves who may and who may not run for elections, not even touching upon the election law. Mr.Carlson proposes that the wording of this question should be as follows, УDo you consider that it is right to divide citizens into two categories Ц one, who may vote (all citizens) and the other, less in number, more exclusive group who may take posts?Ф Such formulation of the question precisely characterizes the heart of the matter. Majority of Western democratic states gave up aristocracy as a class of society with special rights for many years. The current election law creates a new УaristocracyФ in Latvia that is composed by those citizens, who want to take an elected position. Due to this reason Western democratic states consider that state language proficiency norm contradicts universal international human rights and juridical standards. There are better and more democratic means how to preserve and ensure for the Latvian language the status of the state language. And reestablishing superiority Ц a group of citizens, who have more rights than others, is not one of them. Ltd. Board V.Serdans. No Vesti Segodnya interviewed several Latvian MPs concerning the decision of Lithuanian parliament to amend the Constitution and grant non-citizens election right in local government election. J.Dobelis (FF/LNNK) stated that it was internal meter of Lithuania. Latvia should study international practice but when taking decisions they have to take into consideration the situation here. J.Lagzdins (PeopleТs Party) has the same opinion. Latvia has fulfilled all recommendations of international organisations concerning human rights. УAnd we do not need to amend our laws any more, including the election laws,Ф said Mr.Lagzdins. B.Cilevich (For Human Rights in United Latvia) spoke about the situation of Russian-speaking population in Lithuania and Estonia saying that one had just to envy those people for their wisdom to elect wise deputies. But many of Latvian politicians lack this property. And for the basis of current pre-election campaign for ruling parties serves nationalism. Therefore before this election politicians will not take such a step. But sooner or later the new Saeima will have to take this step.

A great competition among Latvias Way, People's Party and Einars Repse's to-be "New Era" (Jaunais laiks) is expected at the next Saeima elections, when the People's Party could become unnecessary, Maris Grinblats, chairman of FF/LNNK, said during the party council's meeting on Saturday. Grinblats said that the split within the Latvian Social Democratic Workers Party (LSDSP) has also damaged this party. In commenting on FF/LNNK's prospects at the elections, Grinblats said that the toughest moment is already in the past, he also stressed that those members who quit the party have not effected its rating. The beginning of the year was very successful for the party, which is proved by the increasing number of TB/LNNK members.

Grinblats said, in commenting on countrys political situation, that the amendments to Saeima and municipal election laws, proposed by the President, are now the most pressing issue. The psychological aspect, not the legal, is most important in the amendments. Grinblats believes that in case the amendments are passed, those people who do not wish to learn Latvian would be implied that they might well not learn the language. He is also concerned that one cannot be sure if this is the last European Union's requirement for Latvia.

Latvian Human Rights and Ethnic Studies Center director Nils Muiznieks argues against Peoples Party leader Andris Skeles statements regarding language requirements for election candidates. Nils Muiznieks is surprised that the leader of Peoples Party is not so well informed about the stance of the EU, NATO and western countries regarding the removal of language requirement and Latvias NATO bid. Muiznieks also provides statements made by NATO, the EU, EC, OSCE and the USA regarding the abolishment of language requirement.

The United States that earlier supported the closure of the OSCE Mission to Latvia now expect the Baltic state to act on the proposal by President Vaira Vike-Freiberga to abolish language qualifications under election laws. The US encouraged Latvia to follow the President's initiative in the letter sent to the Latvian foreign minister by US Vice-Secretary of State Richard Armitage. But now we expect your government and parliament to amend the election laws as courageously promised by your President," Armitage said in the letter that reached the Latvian foreign minister. Foreign Affairs Minister I.Berzins believes that the letter from U.S. Vice-Secretary of State Richard Armitage, cannot be regarded as an attempt to exert political pressure. The minister told that the U.S., as well as the EU, backs Latvia's move to the EU but wants the same rules to be in effect in Latvia as they are in the U.S. and EU. The minister points out that Latvia itself wants to join the EU and no one forces it to do so, therefore Latvia must respect the opinions of the countries whose union it wants to enter. If a proposal on lifting the requirement for deputy nominees pertaining to their state language fluency is regarded as pressure, then the approximation of Latvian legislation in accordance with EU standards can also be regarded as pressure, the minister said. Berzins added that the U.S. was the country which backed closure of the OSCE mission to Latvia without setting any pre-conditions but it does not mean that Latvia does not have to adjust its legislation in adherence with global practice.

FHRUL called President Vaira Vike-Freiberga to turn to the Constitutional Court over state language proficiency requirement under the Election Law. "We call on the President of the state to exercise her statutory right and to propose to the Constitutional Court to cancel this legislative provisions incompatible with the Constitution and Latvia's international obligations," the leftist parliamentary faction said in a statement released Thursday. Leftists support the president's initiative to abolish the state language proficiency requirement under the Election Law but opposes the idea to combine this abolishment with other amendments aimed at strengthening position of Latvian as the state language. These amendments will result in further restriction of ethnic minority rights to use their native languages, claimed FHRUL. Latvian President Vaira Vike-Freiberga so far has neither supported nor rejected the suggestion by leftist alliance to ask the Constitutional Court to examine legality of state language proficiency requirement under the effective election law. LatviaТs Way proposal to amend Article 4 of the Constitution by adding that Уthe Latvian language is the sole working language at state and municipal institutionsФ is to be reviewed by the Coalition Council. Chas provides its interpretation of PresidentТs initiative. It writes that PresidentТs initiative and MPs response should not be assessed only as PresidentТs failure. First, her rating probably will grow because the Russians will give positive assessment to the initiative and the Latvians, in their turn, should also be positive about that as they received rather detailed explanation why Latvia needs these amendments. Second, the international community has also appreciated Latvian PresidentТs step. The newspaper also considers PresidentТs further steps. Involvement of the Constitutional Court is the most likely and the most suitable solution for this issue, believes the newspaper.

columnist Viktors Avotins looks into the issue concerning PresidentТs initiative and MPsТ response to it. Avotiтр believes that the existing circumstances are the main reason why PresidentТs initiative did not receive support of deputies. In his opinion, in fact, there are no sound arguments that the abolishment of language proficiency requirement for election candidates is the decisive factor for LatviaТs NATO membership. Second, he blames politicians for speculations with language and national issues just for boosting their ratings. Third, he thinks that big country language laws should not be mechanically applied to small countries. And fourth, he refers to provisions in international norms, which provide for that exercising of certain rights is linked to specific obligations and responsibilities, meaning that is up to politicians to observe moral values and obligations towards the country. columnist Viktors Avotins looks into the issue concerning PresidentТs initiative and MPsТ response to it. Latvian President Vaira Vike-Freiberga and Prime Minister Andris Berzins took part in the launching event. In her speech President Vaira Vike-Freiberga again rejected concern about her legislative initiative possibly resulting in bilingualism in the country. The Latvian President put much irony and sarcasm in her comments on negative attitude by parliamentary factions to her legislative initiative. She suggested that if the faction were so worried about the state language status that State Language Commission should rush to adopt in next few weeks recommendations for protecting Latvian language. "Let the factions demonstrate to their electorate how much they love the Latvian language," said Vike-Freiberga. Latvian Prime Minister Andris Berzins said the State Language Commission had a very vital role, being an independent institution without any politicians or civil servants among its members. The commission chairwoman, famous Latvian poetess Mara Zalite, said that sub-commissions are likely to produce first working plans with specific proposals in two weeks. By late February the commission chairwoman in cooperation with the State Chancellery has to draft the commission's by-laws and select sources of funding required by the State Language Commission over next three years.
